not sure how it works with DUI checkpoints (they really don't do them here) but if you refuse to take the breathalyzer or comply with an officer doing a DUI test on you here they revoke your license for 6 months and they book you for the night. When you sign your license you are signing that you comply to do a DUI test whenever asked.

yeah, I'm going to go ahead and assume that if you don't comply at a stop point they book you for the night for failure to comply with a field sobriety test. When they book you they take your blood and run it for BAC. The penalties are not as harsh as a DUI but it's not fun having your license revoked in a city like Jacksonville, where driving it literally a must

In WA, they have to already be arresting you.

"Any person who operates a motor vehicle within this state is deemed to have given consent, [...] if arrested for any offense where, at the time of the arrest, the arresting officer has reasonable grounds to believe the person had been driving or was in actual physical control of a motor vehicle while under the influence[...]" -RCW 46.20.308

Where I grew up (think cars) I don't think there were any impairment laws. The buckeye state though....well......

Yeah, here you would've been pulled from the car and placed in handcuffs till they could figure out what to do with you. Check points in NY are zero tolerance, so more than likely you'd be arrested.

Drums I am fairly sure that is exactly what they do if you refuse at a DUI checkpoint. They just started that policy not even a year ago I remember reading it in the paper. Also, yes, having no license in Jacksonville is terrible.

In Texas, a warrant is required to force a blood/breath test; however, at certain times it is publicized that there are assistant DAs standing by to fast track the warrant. Basically, it isn't possible to refuse, because they will get the warrant and force the test in under an hour.

Here in Germany the cops don't fuck around. You WILL comply with their demans or they WILL kick your ass and then FORCE you to submit to a breathalyzer test.

However, you have to understand the drunk driving is a HUGE problem over here. Basically the Polizei can't afford to be nice.

All I see is somebody refusing to incriminate himself which would then give the police a reasonable suspicion that he may be impaired. Without cause detaining him would be a violation of his 4th amendment rights.

they should have arrested you for not answering the officer. if i did that i would have been locked up and they would have threw out the key. and then they would say oops!!

WOW, hope all your kids will die because of an car accident just because some "Mr. Wise-Guy-I-know-my-rights-how-to-move-on" gets easily thru some checkpoints!

YOU have the right not to answer any of their questions. YOU have the right to refuse getting out of the car for a field sobriety test. THEY have the right to still request a breathalyzer test, which if YOU refuse will lead to your being taken into custody and having your license suspended for 6 months or more in most of the states where DUI checkpoints are not prohibited by state law or state constitution.

By the way, these checkpoints statistically don't reduce drunken driving, but do increase state coffers with all the fines that are given for equipment violations, expired plates, no insurance, seat-belt violations, and all the other things they WILL ticket you for, even if you're sober as a church mouse.
